In Oregon, the general statute of limitations for personal injury claims is two years from the date of the injury (ORS 12.110). However, if your accident involves a government entity—such as a TriMet bus or a City of Portland vehicle—you must file a formal Tort Claim Notice within 180 days. Failing to meet these specific Oregon deadlines can result in the permanent loss of your right to seek compensation.
Yes. Oregon follows a modified comparative negligence rule (ORS 31.600). You can recover damages as long as you are not more than 50% responsible for the accident. For example, if a jury determines you were 20% at fault for a crash on I-5 because of a minor distraction, your total settlement would be reduced by 20%. If you are found to be 51% or more at fault, you cannot recover any compensation under Oregon law.
Portland’s unique traffic infrastructure—including the Tilikum Crossing and extensive bike lanes—requires specific legal knowledge. If injured, you should first seek medical care at local trauma centers like Legacy Emanuel or OHSU. Because Oregon is a “no-fault” state for Personal Injury Protection (PIP), your own auto insurance (if you have it) typically covers the first $15,000 of your medical bills, even if you were walking or cycling at the time of the collision.
While most cases settle out of court, if a lawsuit is filed, it will likely be heard in the Multnomah County Circuit Court (located at the Central Courthouse in downtown Portland). Oregon law requires most civil cases with a value under $50,000 to go through court-annexed arbitration first. This is a less formal process than a full jury trial and is designed to resolve Portland injury disputes more efficiently.
Unlike many other states, Oregon generally does not have a cap on “non-economic damages” (pain and suffering) for most personal injury cases. While there is a $500,000 cap specifically for wrongful death claims (ORS 31.710), standard injury claims—such as those involving traumatic brain injuries or spinal damage—do not have a fixed ceiling. This allows Portland juries to award compensation based on the actual impact the injury has had on your quality of life.
