Yes. Oregon follows a modified comparative negligence rule (ORS 31.600). You can recover damages as long as you are not more than 50% responsible for the accident. For example, if a jury determines you were 20% at fault for a crash on I-5 because of a minor distraction, your total settlement would be reduced by 20%. If you are found to be 51% or more at fault, you cannot recover any compensation under Oregon law.
